How to Use Small Claims Court for Security Deposit Disputes

Small claims court is the fastest and most accessible venue for security deposit disputes in California. The filing fee is modest, no attorney is required, and cases are typically heard within 30 to 70 days. For disputes under $12,500, it’s usually the right venue.

How to File

File at the small claims court in the county where the rental property is located. Bring: copies of your lease, move-in and move-out inspection checklists (if any), photographs of the unit at move-in and move-out, all communications with the landlord about the deposit, and the landlord’s itemized statement or failure to provide one.

The landlord’s failure to return the deposit within 21 days is automatic evidence. If the landlord didn’t return the deposit or provide an itemized statement within 21 days, they’ve already violated the statute. Courts regularly award twice the wrongfully withheld amount in these cases. Tenants who arrive with a documented timeline and copies of their communications typically prevail.

The California Tenant Defense System gives renters the exact tools, templates, and step-by-step guidance to fight illegal evictions, recover wrongfully withheld security deposits, and enforce habitability rights — without paying an attorney to get started. Request your free evaluation here.
