How to File a Habitability Complaint With California Code Enforcement

When your landlord refuses to repair habitability defects — broken heat, water damage, pest infestation, structural problems — filing a complaint with your local code enforcement agency or health department is both your right and one of the most effective pressure tools available to California tenants. Code enforcement can compel repairs that a demand letter cannot, and the official complaint record is powerful evidence in any subsequent legal proceeding.

Who Handles Habitability Complaints

Habitability complaints in California are handled by multiple agencies depending on the nature of the violation and the jurisdiction. Your city or county Building and Safety Department handles structural issues, unpermitted work, and building code violations. The County Health Department or Environmental Health handles sanitation, pest infestation, sewage issues, and other health hazards. The City Housing Department (where one exists) handles rental housing code compliance broadly. In some cities, a dedicated Rent Board or Tenant Services office receives habitability complaints and coordinates enforcement.

How to File an Effective Complaint

Document the condition thoroughly before filing: photographs with timestamps, video showing the extent of the problem, and a written description of when the condition began and what communications you’ve had with the landlord. File the complaint in writing, by email if possible, so you have a record. Describe each condition specifically — “broken window in bedroom” rather than “several things are wrong.” Include the property address and your contact information. Request a copy of the inspection report after the agency completes their inspection.

The Retaliation Protection

Filing a code enforcement complaint is a protected activity under California Civil Code Section 1942.5. Any adverse action your landlord takes within 180 days of your complaint — eviction notice, rent increase, reduction of services — is presumed retaliatory. Document the timing of your complaint and any subsequent landlord action.
