Senior and disabled tenants in California have a set of protections beyond those available to all tenants — additional notice periods, additional eviction protections, and priority access to certain legal aid resources. Understanding these enhanced protections ensures that seniors and disabled renters fully use every legal tool available to them.

Extended Notice Periods

California law provides extended eviction notice periods for senior and disabled tenants in specific circumstances. Under AB 1482, tenants who are 62 or older or who are disabled and have lived in a unit for one year or more receive a 12-month notice period for owner move-in and Ellis Act evictions, rather than the standard 120-day period. This one-year notice period is one of the most significant protections available to senior and disabled long-term tenants, giving them substantially more time to find alternative housing.

Additional Local Protections

Many California cities with rent control provide additional protections for senior and disabled tenants beyond what AB 1482 requires. San Francisco’s Rent Ordinance provides specific protections for seniors and disabled tenants facing eviction, including hardship exemptions from some types of eviction. Berkeley, Oakland, and other cities have similar senior and disability protections. Check your local ordinance — the protections available to you may significantly exceed the state minimum.

Reasonable Accommodation in the Eviction Context

Disabled tenants facing eviction have the right to request reasonable accommodation from the court — additional time to respond to a court filing, additional time to find alternative housing, or other modifications of standard court procedures that are necessary because of the disability.
