Moving Out in California: How to Protect Yourself at End of Tenancy

The end of a tenancy is when security deposit disputes, damage claims, and final rent payments become contested — and when the steps you take in the final weeks can make the difference between getting your full deposit back and losing hundreds or thousands of dollars. A systematic move-out process protects you from the most common landlord claims.

Request the Pre-Move-Out Inspection

California law requires landlords to offer a pre-move-out inspection at least two weeks before the tenancy ends if the tenant requests one. At this inspection, the landlord must provide a written itemized statement of conditions that, if left uncorrected, the landlord intends to deduct from the security deposit. This gives you an opportunity to make repairs before vacating — much cheaper than the landlord’s deduction would be. Request the pre-move-out inspection in writing and keep a copy of the request. If the landlord fails to offer it after your written request, they may be limited in what they can subsequently deduct.

The Move-Out Walkthrough

Conduct your own thorough move-out walkthrough with the same camera you used at move-in. Photograph every surface, every appliance, every room. Compare to your move-in photos — document that conditions shown in move-in photos haven’t changed, or that changes reflect normal wear and tear rather than damage. Consider conducting this walkthrough with a witness who can corroborate your account of the unit’s condition.

Final Steps

Return all keys on the last day of the tenancy and get a receipt. Provide your forwarding address in writing to the landlord on your last day — the landlord must send the itemized statement and deposit to this address within 21 days. Keep a copy of every document you give the landlord. Stop automatic payments on the last day of the tenancy. Document the date you vacated with a timestamped photo taken from outside the unit.
