The Habitability Checklist: Is Your Rental Unit Up to Code?

California law defines specific conditions that make a rental unit uninhabitable. This checklist helps tenants identify which conditions they’re living with — and which violations they have legal standing to enforce.

Conditions That Breach the Warranty

Check for: active water leaks or moisture intrusion, visible mold or mildew, infestation by rodents, cockroaches, bed bugs, or other vermin, non-functioning heating system (landlord must provide heat), broken or missing window locks or door locks, inoperable plumbing or inadequate water pressure, non-functioning electrical outlets or exposed wiring, inadequate lighting in common areas, and accumulation of garbage or debris in common areas.

Code enforcement reports transform your list into evidence. A self-created checklist is a starting point. A code enforcement inspection report that itemizes the same conditions is government-created evidence that carries significantly more weight. Call your local code enforcement agency and request an inspection. The report they produce becomes one of your most valuable documents.

The California Tenant Defense System gives renters the exact tools, templates, and step-by-step guidance to fight illegal evictions, recover wrongfully withheld security deposits, and enforce habitability rights. Request your free evaluation here.
